Jenny Craig Single Entry Terms and Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Any entry not complying with these Terms and Conditions will be deemed invalid. Participation in this competition is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia aged 18 years and over, who are able to comply with the entry requirements detailed below. Employees of the Promoters, their immediate families and any agencies associated with this promotion are ineligible to enter.
3. The competition commences 5th February 2010 and concludes 30th April 2010 at 11:59pm (AEST) (“Competition Period”). Entrants must register and attend a Jenny Craig centre for their first weigh-in at least twenty eight days before the end of the Competition Period (i.e., by 2nd April 2010).
4. Entrants must:
i. Either register their details online at www.greatestweightlosschallenge.com.au (they will then receive a confirmation email which will provide details on how, where and when to weigh in at their nearest Jenny Craig Centre) or visit a Jenny Craig centre and register their interest.
ii. Visit a Jenny Craig Centre as notified on a Saturday between the hours of 12pm-3pm, Monday between the hours of 8am-10am, Wednesday between the hours of 6pm-8pm or Friday between the hours of 1pm-3pm during the first 3 weeks of the Competition Period, or alternatively either make an appointment with the centre directly to visit during regular opening hours or attend the ‘Australia’s Greatest Weight Loss Challenge’ launch event on the 8th February in Martin Place, Sydney. Jenny Craig reserve the right to change the aforementioned times depending on numbers attending. If an entrant wishes to join the competition after the first 3 weeks of the competition period, they may make an appointment to visit a Jenny Craig centre during regular opening hours. The entrants first visit and weigh-in must be at least four weeks before the end of the Competition Period (i.e., by 2nd April 2010).
iii. Be weighed by Jenny Craig staff. Entrants will be given a official weigh in card which will be marked with their starting weight as recorded during their first visit to Jenny Craig. This card will be marked throughout the Competition Period with the entrants weight every time they weigh in at a Jenny Craig centre. Entrants must weigh in before they have their card marked to ensure it is valid. Valid entries must demonstrate that the entrant has weighed in at a Jenny Craig centre at least twice during the competition period, with the last weigh in occurring during the last two months of the Competition Period (i.e., between 5th March and 30th April 2010 inclusive) and at least twenty eight (28) days after the entrant’s first weigh-in. Entrants will be reminded via email to visit the Jenny Craig centres for their final weigh in between the hours of 12pm-3pm on Saturdays during the last 3 weeks of the Competition Period. Jenny Craig reserve the right to change the aforementioned times depending on numbers attending. Entrants must retain their marked official weigh in card as proof of validity for entry into the competition and need to be able to present it on request.
iv. Have a starting BMI (Body Mass Index) of 20 or higher when they attend Jenny Craig for their first weigh-in. This will ensure entrants are not underweight and are able to participate in the competition safely. Staff at the Jenny Craig centres will calculate the BMI of entrants when they weigh in and this will determine their eligibility to enter the competition. Jenny Craig may exclude any person from participating in this promotion if that person, in Jenny Craig’s absolute discretion, may not be able to safely participate.
v. Lose a minimum of 5 kg while participating in Australia’s Greatest Weight Loss Challenge (based on the difference in weight between their first and last weigh-ins).
vi. During the Competition Period, entrants must also log onto www.greatestweightlosschallenge.com.au and where prompted write a response to the following: “How Australia’s Greatest Weight Loss Challenge has changed my life”. Valid entries must contain the following information:
a) a statement on: “How Australia’s Greatest Weight Loss Challenge has changed my life”;
b) the entrant’s first and last name;
c) the entrant’s address;
d) The entrant’s e-mail address;
e) the entrant’s daytime telephone number and area code; and
f) How many kilos they have lost while participating in Australia’s Greatest Weight Loss Challenge (i.e., the difference in weight between the first and last weigh-ins).
5. Entrants must retain their original official weigh in card with evidence of at least two (2) weigh-ins, with the last weigh-in occurring within the last two months of the Competition Period (i.e., between 5th March and 30th April 2010 inclusive) and at least twenty eight (28) days after the entrant’s first weigh-in. Failure to produce the original official weigh in card when requested may, in the absolute discretion of the Promoter, result in invalidation of the entrant’s entry and forfeiture of any right to a prize.
6. Only one entry per person permitted. The Promoters reserve the right to verify the validity of entries, entrants' identity, age, age of their children and place of residence, and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with an entry, who breaches any of these Terms and Conditions, or who jeopardises the fair and proper conduct of the competition process. Errors and omissions may be accepted at the Promoters' complete discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights.
7. The competition will be judged by a panel of judges appointed by the Promoters. The best entry as determined by the judges will win $10,000 cash, which will be awarded in the form of a cheque made out to the winner. The winner will be notified by telephone and mail using contact details provided in their entry. This competition is a game of skill and chance plays no part in determining the winners. All valid entries received during the Competition Period will be individually judged based on literary and creative merit and originality. The amount of weight lost by an individual over the Competition Period (except for the amount required to satisfy the entry requirements) will NOT form part of the judging criteria.
8. Total prize pool is valued at $10,000. Prizes, or any unused portion of a prize, are not transferable or redeemable for cash.
9. Except for any liability that cannot be excluded by law, the Promoters (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters' control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any tax liability incurred by a winner or entrant; and (e) redemption of a prize.
10. Promoters' decision in relation to all aspects of this competition is final and binding on all who enter and no correspondence will be entered into.
11. Entrants consent to the Promoters using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) and/or response to the promotional question in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.
12. All entries submitted in connection with this competition become the property of the Promoters. Entries will not be returned to any entrant. As a condition of entering into this competition, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoters. Each entrant warrants to the Promoters that each entry submitted is an original creative work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoters are entitled to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.
13. The Promoters collect personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoters and their promotional sponsors (including but not limited to NineMSN) may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoters.
